Terms and Conditions

These terms and conditions (“Terms”) govern your use of Marina Match also known as MarinaMatch.org, owned and operated by Marina Match Pty Ltd

Marina Match (including any subdomains) operates across desktop, mobile, tablet and apps all of which shall be known as the “Platform” and referred to as “we”, “us”, or “our” in these Terms & Conditions.

1. 1. Use of the Platform
   • Our Platform facilitates the connection between marinas and marina users for booking, rental and sales purposes. You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Platform by any third party.
   • You agree not to use the Platform to engage in any unlawful or fraudulent activity, including but not limited to misrepresenting information, posting false or misleading content, or violating any applicable laws or regulations.
   • The Platform and its content is provided for viewing and the prescribed use by subscribers only and is not to be copied, modified, linked, framed or published in any other Platform or media without our written consent
2. 2. User Accounts
   • In order to access certain features of the Platform, you may be required to create an account. You agree to provide accurate and complete information when creating your account and to keep your login credentials secure.
   • You are solely responsible for all activity that occurs under your account, and you agree to notify us immediately of any unauthorised use of your account or any other breach of security.
3. 3. Listings and Bookings
   • Marina owners may create listings for their marinas on the Platform, including information about availability, pricing, and amenities.
   • Marina users may book reservations through the Platform subject to availability and the terms set by the marina owner.
   • 3.3. We do not endorse or guarantee the accuracy or quality of any listings or bookings made through the Platform. Marina owners and users are solely responsible for their interactions and transactions.
   • It is the seller's responsibility to provide truthful and honest information about any listing placed on the Platform and to show the full cash price, including GST where applicable. It is the seller's responsibility to correct and/or delete misleading and/or incorrect information from the listing upon request. If the seller fails to delete or correct misleading or false information, we reserve the right to change said information or delete the listing completely without notice and without refund.
   • 3.5. The content of any published listing cannot be changed to advertise another product unless our permission has been given to do so. If the details or photos of a listing are amended and the change is deemed to be in breach of these Terms it may result in your account being suspended and your listing being removed from the Platform completely without notice and without refund. Marina Match reserves the right to cease access to the Platform or any of its services without notice at its sole discretion.
   • There is a listing fee of AUD 55.00 for every sales listing.
   • Marina Match charges a fee of 3.3% of the total price for a rental listing.
   • Prices may change without notice. All payments are final and refunds are only given in case of system error.
4. 4. Payment and listing fees
   • Payments for bookings made through the Platform may be processed by third-party payment processors. By making a booking, you agree to abide by the terms and conditions of the applicable payment processor.
   • We are not responsible for any disputes or issues that may arise regarding payments or refunds. Any disputes should be resolved directly between the parties involved.
   • For a rental marina property, the payment will be cleared when the marina users check in. We are not responsible for any delays in payment procedures caused by third-party payment processors or financial institutes.
5. 5. Insurance
   • The Platform owner shall not be held liable for any damages, losses, or injuries sustained by users as a result of their failure to secure appropriate insurance coverage, including but not limited to public liability insurance. Users acknowledge and agree that it is their sole responsibility to obtain and maintain sufficient insurance policies to cover their activities and interactions facilitated by this Platform. By using this Platform, users accept these terms and conditions and confirm that they have read and understood their obligation to secure their own insurance coverage.
6. 6. Intellectual Property
   • All content and materials available on the platform, Platform, including but not limited to text, graphics, logos, images, and software, are the property of Marina Match or its licensors and are protected by copyright, trademark, and other intellectual property laws.
   • You may not reproduce, modify, distribute, or otherwise, use any content from the Platform without our prior written consent.
7. 7. Limitation of Liability
   • To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any third party on the Platform; (c) any content obtained from the Platform; or (d) unauthorised access, use, or alteration of your transmissions or content.
   • Accuracy of Information: We make every effort to provide accurate and up-to-date information regarding marina berths, moorings, and other marine properties available for booking or sale. However, we do not guarantee the accuracy, completeness, or reliability of any information provided on our platform.
   • Third-Party Listings: Listings of marina berths, moorings, and marine properties on our platform are provided by third parties, including marina operators and property owners. We do not own, control, or manage these properties directly. Therefore, we cannot be held responsible for the availability, condition, legality, or any aspect of third-party listings.
   • Booking and Transactions: Users of our platform are responsible for conducting their own due diligence before booking or purchasing any marina berth, mooring, or marine property listed on our platform. We do not oversee or guarantee the performance of any booking, transaction, or agreement made between users and third-party property owners.
   • Limitation of Liability: In no event shall Marina Match be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our platform, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.
   • User Responsibilities: Users are responsible for complying with all applicable laws, regulations, and contractual obligations when using our platform to book, manage, or sell marina berths, moorings, or other marine properties. Marina Match assumes no liability for any violations or disputes arising from user activities.
   • By using our platform, you acknowledge and agree to these terms of liability. If you do not agree with any part of these terms, you should refrain from using our services.
   • We will not be liable for any loss or damage caused by a distributed denial of service attack, viruses or other harmful material that may infect your computer equipment, computer programmes, data or other proprietary material due to your use of the Platform or downloading any material posted on it or any Platform linked to it.
8. 8 Use of Personal information
   • Any personal information that we may collect from you on our Platform, whether on online forms or as part of the reservation process, will be dealt with in accordance with our Privacy Policy http://www.marinamatch.org/privacy[SB1]
   • Your data protection and privacy rights are set out in our Privacy Policy. You agree to the use of your personal information and data in accordance with our Privacy Policy.
9. 9. Virus, Hacking and other offences
   • You must not misuse the Platform or the Marina Match App by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or harmful. You must not attempt unauthorised access to the Platform, the server on which the Platform is stored or any server, computer or database connected to the Platform or the Marina Match App, or attack the Platform via a denial of service attack, distributed denial of service attack or other similar means.
   • We will not be liable for any loss or damage caused by a distributed denial of service attack, viruses or other harmful material that may infect your computer equipment, computer programmes, data or other proprietary material due to your use of the Platform or downloading any material posted on it or any website linked to it.
10. 10. Written communication
    • Applicable laws require that some of the information or communications we send to you should be in writing. When using our Platform, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our Platform. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
11. 11. Notices
    • All formal notices given by you to us must be given to Marina Match Pty Ltd (ABN 14 668 624 977).
    • We may give notice to you at either the email or postal address you provide to us when using our Platform, or in any of the ways specified in clause 8 above.
    • Notice will be deemed received and properly served immediately when posted on our Platform, twenty four (24) hours after an email is sent, or three (3) days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an email, that such email was sent to the specified email address of the addressee.
12. 12. Indemnification
    • You agree to indemnify and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable attorney’s fees and costs, arising out of or in any way connected with (a) your access to or use of the Platform; (b) your violation of these Terms; or (c) your violation of any third-party rights, including without limitation, any intellectual property rights or privacy rights.
13. 13 Changes to Terms
    • We reserve the right to modify these Terms at any time, effective upon posting on the Platform. Your continued use of the Platform after any such changes shall constitute your consent to such changes.
    • We have the right to revise and amend these Terms from time to time by posting them on the Platform. Amendments may be made to reflect changes in law, operational practices, or to enhance user experience. These Terms may also be amended for any other reason at our discretion.
    • You will be subject to the policies and Terms in force at the time that you book or manage marina berths, moorings, or other marine properties through our Platform, unless any change to those policies or these Terms is required to be made by law or governmental authority (in which case it will apply to bookings previously made by you).
      We may also notify you of changes to these policies or Terms before you confirm any bookings. In such cases, we will assume that you have accepted the change to these Terms unless you notify us otherwise within seven (7) working days.
14. 14. Governing Law
    • These Terms shall be governed by and construed in accordance with the laws of New South Wales of Australia, without regard to its conflict of law principles.

16. We reserve the right to change these Terms without prior notice. By using our Platform, you acknowledge that you      have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these      Terms, you may not access or use the Platform.
